LAW in the form of an Instruction for Criminal Procedure. Given in Paris, October 21, 1791. S.l. [Toulon], De l'Imprimerie de Mallard, s.d. In-4, 76 pages, in sheets sewn with thread. Important law developing in detail the organization of the new criminal procedure in France. Its publication comes a few weeks after the promulgation of the first French penal code. "The National Assembly, in its concern to provide for public safety by the repression of offences which disturb society, felt that the accomplishment of this goal required the assistance of two powers, that of the police and that of the judiciary. The police, considered in its relations with public safety, must precede the action of the judiciary; its vigilance must be its principal character: society, considered en masse, is the essential object of its solicitude. » The law provides, in particular, for the trial of criminal cases, the creation of a special court in each department: this institution is at the origin of the Assize Court. Note the use in the text (pp. 3 and 14) of new terms that appeared during the Revolution: police officer, national gendarmerie (new name for the maréchaussée from 1791) and arrest warrant. This provincial edition was printed by Mallard, printer for the Var department assembly, in order to be sent to the Department's District Administrations. Mention in pen on the first page: St-Tropez.
